Kodak sues HTC, Apple over patent infringement

The two smartphone and tablet vendors are infringing on its digital imaging technology, the company alleges

Struggling Eastman Kodak is alleging that Apple's and HTC's smartphones and tablets infringe on its digital imaging technology, and has filed a complaint and lawsuits with the U.S. International Trade Commission (ITC) and the U.S. District Court for the Western District of New York, it said on Tuesday.

The complaint to the ITC claims that some of Apple's iPhones, iPads, and iPods, and HTC's smartphones and tablets, infringe Kodak patents related to technology for transmitting images.

Kodak also alleges that HTC's smartphones infringe on a patent related to a method for previewing images, which is already the subject of pending actions against Apple.

Separately, Kodak also filed suits against Apple and HTC in U.S. District Court for the Western District of New York alleging the same infringement, it said.

Four patents are the basis for Kodak's actions, including one for "automatically transmitting images from an electronic camera to a service provider using a network configuration file" and another patent for "capturing digital images to be transferred to an email address."

Kodak wants the ITC to stop the import of products that infringe on its patents, and has asked the District Court to stop Apple and HTC from infringing on the patents and award it damages.

Kodak has had numerous discussions with both companies in an attempt to resolve this issue, but has failed to reach an agreement, it said. The company's goal isn't to disrupt the availability of Apple's and HTC's products, but to get "fair compensation for the unauthorized use" of its technology, it said.

An HTC spokeswoman declined to comment until the company had reviewed the complaint. Apple didn't answer a request for a comment.

Kodak has already licensed patents related to its digital imaging technology to more than 30 companies, including LG Electronics, Motorola, Samsung Electronics and Nokia, it said.

The company is also using the technology in its own products, including two new cameras that were launched at the Consumer Electronics Show (CES).

Toward the end of last year, Kodak lowered projections for its full-year revenue and year-end cash balance, and on Jan. 3 warned that it could face delisting from the New York Stock Exchange, according to a filing with the U.S. Securities and Exchange Commission.

The company has warned that performance this year will depend on it selling its digital imaging patents to raise cash for future investments, and there have been reports that the company is preparing to seek bankruptcy protection.

In this age of intellectual property lawsuits, patents have proven to be a very valuable commodity. For example, last year, Nortel sold 6,000 patents and patent applications for $4.5 billion to a consortium consisting of Apple, EMC, Ericsson, Microsoft, Research In Motion and Sony, following a bidding war with Google, which later made a $12.5 billion bid to buy Motorola Mobility. The reasoning behind that deal is in part to better protect Android from patent lawsuits.

HTC and Ice Cream Sandwich: New list appeared

Just over two months, HTC has officially been known various devices , which the "Android 4.0 Ice Cream Sandwich" - Update be received officially. From other devices, unfortunately, was never mentioned until now and also a publication date of the update for the confirmed units, was never called. In summary we can say that this list but does not bring with it great news but still makes for some clarity. At least we now know that early in 2012 but is "earlier" than expected and planned for the update for EVO 3D was already the end of 2011.

Also, we now also know what devices are probably still talking. Personally, I am pleased to see that even the HTC Desire is still considered quite feeble, and the HTC Wildfire S is a candidate for ICS Update also.

I really would like to point out again that this list is not given out officially by HTC confirms Turkey /. Only one user has it written on the whiteboard. It could be just as good or even tinkered as speculation of a Turkish blog originate. At this point, many thanks to "Erdem Erbil," who gave me everything translated.

HTC Releases Unaudited Results For 4Q 2011

HTC quarterly net lags forecast amid tough competition

Taiwanese smartphone maker HTC Corp recorded a worse-than-expected yearly profit decline in the fourth quarter, and the first decline in two years, as its models scrambled to compete with Apple Inc's iPhone and Samsung's Galaxy range.

The erstwhile investor darling shocked markets in November by slashing its fourth-quarter revenue guidance, sending its shares down 28 percent in two weeks and 15 percent to date.

Investor concerns linger over whether HTC still has the innovative streak that catapulted it from an obscure contract maker to a top brand.

Samsung Electronics, the world's top maker of memory chips and smartphones, on the other hand reported a record quarterly profit on Friday, aided by one-off gains and best-ever sales of high-end handsets.

HTC's net profit in October-December was down 25.5 percent to T$11.02 billion ($364.26 million), compared with T$14.80 billion a year earlier and T$18.68 billion in the previous quarter, it said on Friday.

Eighteen analysts have forecast a profit of T$13.33 billion for the world's No.4 smartphone maker, according to a poll by Thomson Reuters I/B/E/S.

Consolidated sales for December were T$26.36 billion, down 20.3 percent from the same month a year earlier.

Net profit for the full year of 2011 was however up 57 percent from 2010 to T$62.05 billion. It did not give any details in a brief statement.

"December revenue was definitely lower than street expectations; I expect Q1 net profit will continue to fall year-on-year," said KGI securities analyst Richard Ko, citing news that HTC's new models will not start shipments until the second quarter and contribute to revenue.

The company has said it will unveil new models in February that will be better and more competitive, and will include new phones for the high speed LTE (Long Term Evolution) standard in the U.S. market.

JP Morgan upgraded HTC earlier this week to "overweight," while mildly cutting its target price by 1.4 percent to T$680, citing new models expected to showcase next month at the Mobile World Congress that may give the Taiwanese company an opportunity to win back some lost ground.

On Friday ahead of the results announcement, HTC shares closed down 0.72 percent at T$482.

HTC had a fairytale ride in 2010 and early 2011, when its shares more than tripled in the 14 months to April 2011 and sales grew four-fold in 1- years as consumers snapped up its innovative phones with their distinctive large clock numerals.

But an equally rapid fall from grace saw its stock become the worst performer among global smartphone companies last year, down 42 percent, after Blackberry maker Research in Motion Ltd.

Squeezed of late between Apple's huge offering of apps for the iPhone and Samsung's big marketing budget that gives its Galaxy models extra clout, HTC's Desire, Sensation and Wildfire models have struggled to maintain the momentum.

HTC Radiant LTE Windows Phone for AT&T: First Images

The phone pictured above may look a lot like the HTC Titan, but according to a reliable source, this will indeed be a distinct device, the LTE-capable HTC Radiant tipped by Paul Thurrott to land on AT&T.

We've initially heard of the Radiant way back in April when we saw a list of device names trademarked by the Taiwanese manufacturer and then app logs featured the phone in August. More recently, Radiant was rumored to be among a trio of AT&T-bound, LTE-infused Windows Phones poised for launch at CES, along with the Nokia Lumia 900 "Ace" and still-mysterious Samsung Mendel.

There are still a couple of differences between the Titan and the Radiant. First off, the top of the phone not only wears a fairly larger HTC branding but also what appears to be a bigger front facing camera lens. On the right side, the buttons are slightly shifted towards the bottom of the phone, especially in the case of the volume rockers.

The back side is where the big changes are. You can see that the dual-LED flash has been moved to the right side of the camera (and probably the speakers to the left). The unibody build has been also slightly changed: there's a curve to the aluminum above the camera and, according to our source, it has a non-removable battery and slightly different color.

We don't have anything in terms of specs but we can definitely guess a standard Windows Phone configuration (with the 1.5GHz CPU, 512MB of RAM and definitely the same sized WVGA screen like on the Titan). Because of the LTE capability, the 1,600mAh battery on the Titan should definitely be improved on the Radiant in order to power both the radio and the huge 4.7-inch display.

Oh, and according to our source, this device is also going to hit Telstra Australia.

Microsoft's LTE Plans For Windows Phone

Since other sites are starting to leak glimpses of what Microsoft is doing with Windows Phone and LTE in 2012, I've decided to simply reveal what's happening. And as you might expect, Microsoft and its Windows Phone partners do indeed intend to release a number of LTE devices in the coming half-year, all on AT&T.

The information I have relates to the US market only. These plans will be officially revealed at the Consumer Electronics Show (CES) in Las Vegas next month.

Three LTE-based Windows Phone handsets--the Nokia ACE, HTC Radiant, and Samsung Mendel--will ship on AT&T Wireless before the middle of 2012. The ACE is due March 18, 2012.

What's unclear is whether these LTE based devices will be accompanied by a software update of some kind. You may recall that the rumored "Tango" release, supposedly due in early 2012, is about low-end phones. So it's unclear how that jives with LTE, which is obviously a high-end feature. This explains my confusion over the supposed Windows Phone roadmap leak yesterday.

Also, the Nokia Lumia 710 will ship on Verizon Wireless in April 2012. This is not an LTE device, and it's not clear when/if we'll see an LTE Windows Phone on Verizon. The Lumia 710 is codenamed "Sword" and will be available in April 2012. (The T-Mobile version of the Lumia 710 will be available for purchase on January 11, 2012, giving the company three months of exclusivity before the device hits Verizon.)

The change means that customers will be able to apply various software modifications and hacks on their phones freely.

  

HTC claims that unlocking their entire device portfolio is a “complex challenge”, but still promises to bring unlocking ability other devices over time, “as part of maintenance releases and new shipments”.
